Welcome to Movian. These Terms of Service are between you and Movian, LLC (“Movian,” “we,” “us,” or “our”). They explain the rules for using Movian’s website, mobile app, trip booking tools, transportation services, customer support, and related services.
Movian helps customers discover and book curated day trips and micro-adventures by van. Trips may include transportation to trailheads, parks, ski areas, wineries, festivals, events, and other leisure destinations.
By creating an account, booking a trip, joining a trip, or using Movian, you agree to these Terms.
1About Movian
Movian is operated by Movian, LLC, a California limited liability company.
Movian provides and coordinates scheduled van trips, booking tools, trip communications, and related customer services.
Movian trips may include:
- Seat bookings on scheduled van trips
- Pickup and drop-off coordination
- Destination information
- Trip reminders and live updates
- Optional add-ons, such as gear, snacks, rentals, tickets, or other extras
- Customer support
- Ratings, reviews, photos, and post-trip feedback
Some destinations, venues, activities, rentals, tickets, or add-ons may be provided by third parties. Movian is responsible for the Movian booking and transportation experience, while third-party providers remain responsible for their own venues, activities, products, services, rules, and requirements.
2Eligibility
You must be at least 18 years old to create an account or book a trip with Movian.
Children may participate only as allowed by Movian’s trip rules and must be booked by a parent or legal guardian where required. The adult who books for a child is responsible for that child’s conduct, safety, supervision, and compliance with these Terms.
By using Movian, you confirm that you are legally able to enter into these Terms.
3Accounts
You may need to create an account to book or manage trips.
You agree to provide accurate, current, and complete information and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You may not create fake accounts, duplicate accounts, or accounts for another person without permission.
Notify Movian promptly if you believe your account has been accessed without permission.
Movian may suspend, limit, or close accounts that contain inaccurate information, misuse the service, violate these Terms, create safety concerns, interfere with Movian’s operations, or appear to involve fraud or unauthorized activity.
4Bookings
When you book a Movian trip, you are reserving a seat on a scheduled trip, subject to availability, payment confirmation, and any trip-specific requirements.
A booking may include:
- Trip date and time
- Destination
- Pickup point
- Seat reservation
- Add-ons, if available
- Price, taxes, fees, discounts, credits, or promo codes
- Cancellation and refund rules
- Trip-specific notes, restrictions, or requirements
You are responsible for reviewing all trip details before booking, including pickup time, pickup location, trip duration, expected conditions, difficulty level, included items, excluded items, and any participation requirements.
A booking is confirmed only when Movian confirms it through the app, website, email, SMS, or another official Movian communication.
5Booking for Other People
If you book for another person, you are responsible for ensuring that each participant:
- Has accurate booking information
- Receives the relevant trip details
- Understands and follows these Terms
- Meets any age, safety, fitness, waiver, or trip-specific requirements
- Arrives at the correct pickup point on time
If you book for a minor, you confirm that you are legally authorized to do so and that the minor will be supervised as required by Movian’s trip rules.
6Payments, Fees, Credits, and Promo Codes
You agree to pay all charges shown at checkout, including trip prices, add-ons, taxes, fees, and any other amounts disclosed before purchase.
Movian may accept payment by card, Apple Pay, Google Pay, credits, promo codes, or other payment methods we make available.
Payments are processed by third-party payment providers. By submitting payment information, you authorize Movian and its payment providers to charge your selected payment method for the amounts due.
Movian may offer credits, discounts, promo codes, referral rewards, or similar offers. These offers may be subject to additional terms, expiration dates, usage limits, and restrictions. Unless stated otherwise:
- Credits and promo codes have no cash value
- Credits and promo codes are not transferable
- Promo codes may be limited to one use per customer or booking
- Expired credits or promo codes may not be applied retroactively
- Movian may cancel or refuse credits, promo codes, or bookings connected to fraud, misuse, duplicate accounts, or unauthorized resale
If a payment fails, is declined, is reversed, or is disputed, Movian may cancel or hold your booking, restrict your account, or seek payment for amounts owed.
7Cancellations by Customers
Movian’s cancellation rules may vary by trip, destination, add-on, or promotional offer. The applicable cancellation terms will be shown during booking or in the trip details.
Unless stated otherwise in the trip details, Movian’s standard cancellation policy is:
- If you cancel at least 48 hours before the scheduled trip departure, you may receive a refund to your original payment method or Movian credit.
- If you cancel less than 48 hours before the scheduled trip departure, your booking is non-refundable.
- If you do not cancel and do not attend the trip, your booking is treated as a no-show and is non-refundable.
- Certain add-ons, tickets, rentals, destination fees, partner services, promotional bookings, or limited-capacity experiences may be non-refundable.
Refunds are returned to the original payment method when possible. Movian credits may be issued where stated, where selected by you, or where a payment refund is not available.
Refund processing times may vary depending on the payment provider.
8Rescheduling
Movian may allow customers to reschedule certain trips, subject to availability and the applicable trip rules.
Unless stated otherwise, rescheduling is subject to the same timing rules as cancellations. If a new trip costs more than the original trip, you are responsible for the difference. If a new trip costs less, Movian may issue the difference as Movian credit.
Some trips, add-ons, partner tickets, rentals, or promotional bookings may not be eligible for rescheduling.
9Cancellations or Changes by Movian
Movian may cancel, delay, reroute, reschedule, modify, or substitute a trip when we believe it is appropriate due to:
- Weather
- Road conditions
- Traffic
- Wildfire smoke or environmental conditions
- Park, trail, resort, venue, or destination closures
- Safety concerns
- Vehicle issues
- Driver availability
- Minimum booking thresholds
- Partner availability
- Operational constraints
- Emergencies or events outside Movian’s reasonable control
If Movian cancels a trip before departure, Movian will provide a refund, Movian credit, rescheduling option, or other remedy stated in the cancellation notice or applicable trip policy.
Movian is not responsible for costs you incur outside Movian, such as rideshare costs, hotel stays, equipment purchases, missed personal plans, third-party tickets, or other expenses, unless Movian expressly agrees otherwise.
10Weather, Route Changes, and Trip Conditions
Movian trips may be affected by changing weather, traffic, road conditions, park or venue conditions, wildfire smoke, snow conditions, closures, crowds, staffing, destination availability, and other operational factors.
Trip descriptions, routes, timing, estimated arrival times, activity suggestions, difficulty levels, and destination conditions are estimates and may change.
Movian may make reasonable adjustments to a trip when needed for safety, logistics, service quality, or customer experience. This may include changing pickup timing, adjusting the route, substituting a destination, shortening or extending a stop, or modifying the itinerary.
Movian will make reasonable efforts to communicate material changes through the app, email, SMS, push notification, phone, or other available channels.
11Pickup Times, Late Arrivals, and No-Shows
You are responsible for arriving at the correct pickup point on time.
Movian trips operate on a schedule. To respect other customers and maintain the itinerary, drivers may not be able to wait for late passengers.
Unless stated otherwise in the trip details:
- You should arrive at least 10 minutes before the scheduled pickup time.
- The vehicle may depart at the scheduled pickup time.
- If you are late, miss the pickup, go to the wrong pickup point, or are not present when the vehicle departs, you may be treated as a no-show.
- No-shows are not eligible for a refund or credit unless Movian states otherwise.
Movian may attempt to contact you, but we are not responsible if you miss communications because your phone is off, your notification settings are disabled, your contact information is incorrect, you do not have service, or you are unavailable.
12Stops During a Trip
Some trips may include rest stops, destination stops, meal stops, or activity windows.
If a driver or Movian staff member provides a departure time during a stop, you are responsible for returning to the vehicle before that time. The driver may not be able to wait for late passengers.
If you are left behind because you do not return on time, Movian is not responsible for alternative transportation, refunds, lodging, food, or other expenses, unless required by law.
13Customer Responsibilities
You agree to:
- Follow driver and Movian staff instructions
- Treat drivers, customers, destination staff, and the public respectfully
- Arrive on time and prepared for the trip
- Follow applicable laws, venue rules, park rules, trail rules, resort rules, and safety instructions
- Bring any required clothing, footwear, medication, food, water, documents, or personal items
- Accurately describe any relevant accessibility, safety, or logistical needs you choose to share
- Use seat belts and follow vehicle safety rules
- Respect other passengers’ comfort, privacy, and safety
- Keep the vehicle reasonably clean
- Avoid conduct that is unsafe, disruptive, threatening, discriminatory, harassing, illegal, or harmful
Movian may refuse service, remove a customer from a trip, cancel a booking, or suspend an account if a customer violates these Terms, creates a safety concern, disrupts a trip, damages property, or interferes with Movian’s operations.
14Refusal of Service or Removal from a Trip
Movian may refuse service or remove a customer from a trip when reasonably necessary for safety, customer comfort, legal compliance, vehicle operations, or protection of Movian, drivers, passengers, partners, or the public.
Examples include, but are not limited to, situations where a customer:
- Refuses to follow driver or Movian staff instructions
- Acts in a disorderly, abusive, threatening, violent, discriminatory, harassing, or illegal manner
- Appears intoxicated, impaired, or unable to participate safely
- Brings illegal drugs, weapons, hazardous materials, or prohibited items
- Smokes, vapes, or uses cannabis in the vehicle
- Interferes with the driver or vehicle operations
- Refuses to use a seat belt
- Damages the vehicle, gear, destination property, or another person’s property
- Creates an unreasonable health, safety, hygiene, or comfort concern
- Violates venue, trail, park, resort, winery, festival, or destination rules
- Fails to comply with applicable laws or these Terms
A customer who is refused service or removed from a trip for violating these Terms may not be eligible for a refund, credit, substitute transportation, return transportation, or other compensation.
Customers are responsible for losses, costs, damages, cleaning, repairs, claims, or expenses caused by their conduct.
15Safety and Assumption of Risk
Movian trips may involve transportation, outdoor recreation, walking, hiking, snow, heat, cold, uneven terrain, altitude, water, wildlife, insects, plants, changing weather, traffic, crowds, alcohol-serving venues, remote areas, or other conditions that involve inherent risks.
By booking or joining a trip, you understand and accept that these risks may include injury, illness, property loss, travel delays, route changes, exposure to weather or environmental conditions, and other unexpected events.
You are responsible for deciding whether a trip is appropriate for your health, fitness, experience, comfort level, and personal circumstances.
Movian may provide destination information, route information, difficulty descriptions, packing suggestions, weather updates, or safety reminders, but this information may be incomplete, change quickly, or differ from actual conditions. You are responsible for using your own judgment and following applicable safety guidance.
16Waivers and Trip-Specific Requirements
Some trips, destinations, activities, rentals, tickets, or add-ons may require you to sign a waiver, release, acknowledgement of risk, or additional terms before participating.
If a required waiver or acknowledgement is not completed, Movian or the applicable partner may deny participation, and your booking may be non-refundable.
If you book for another participant, you are responsible for ensuring that each participant receives and completes any required waiver or trip-specific requirement.
17Children
Children may participate only on trips where Movian allows them.
A parent or legal guardian must book for and accompany any child unless Movian states otherwise. The parent or guardian is responsible for the child’s safety, behavior, supervision, and compliance with these Terms.
Movian may set minimum age requirements for certain trips based on destination, duration, difficulty, transportation requirements, venue rules, legal requirements, or operational needs.
Children must have their own seat when required by law, trip rules, or vehicle requirements. Parents and guardians are responsible for providing any required child safety seat or booster seat unless Movian expressly states otherwise.
18Accessibility and Mobility Needs
Movian aims to support customers where reasonably possible.
Customers should contact Movian before booking or before the trip if they have accessibility, mobility, medical, or logistical needs that may affect transportation, pickup, seating, storage, destination access, or trip participation.
Movian drivers and staff may provide reasonable trip-related assistance, but they cannot provide personal care services such as lifting customers, administering medication, assisting with restroom use, or providing continuous individual supervision.
Customers who need personal assistance should travel with a companion or personal care assistant.
19Pets and Service Animals
Pets are not allowed on Movian trips unless Movian expressly states otherwise for a specific trip.
Service animals are permitted as required by applicable law. Customers traveling with a service animal may be asked questions permitted by law so Movian can support safe transportation and trip logistics.
Customers are responsible for controlling their service animal at all times. Service animals must remain within the customer’s space and may not block aisles, occupy another customer’s seat, or interfere with safe vehicle operation.
Movian may deny or limit participation where an animal is out of control, not housebroken, poses a direct threat, or cannot be accommodated safely under applicable law.
20Alcohol, Cannabis, and Controlled Substances
Some Movian trips may visit wineries, breweries, festivals, restaurants, or other venues where alcohol is available.
You are responsible for complying with all laws and venue rules related to alcohol, cannabis, and controlled substances. Movian may refuse service or remove a customer from a trip if the customer appears intoxicated, impaired, disruptive, unsafe, or unable to participate responsibly.
Illegal drugs and unlawful possession or use of controlled substances are not permitted on Movian trips or in Movian vehicles.
Smoking, vaping, and cannabis use are not permitted inside Movian vehicles.
21Baggage, Gear, and Personal Items
You are responsible for your personal belongings.
Movian may set limits on baggage, gear, food, drinks, equipment, or other items based on vehicle space, safety, destination rules, or trip type.
Unless stated otherwise, each customer may bring only a reasonable day-trip bag or personal item that can be safely stored. Large items, sports equipment, coolers, skis, snowboards, bikes, strollers, or bulky gear may require advance approval or a trip-specific add-on.
Movian may refuse items that are unsafe, oversized, prohibited, unsanitary, or unsuitable for the vehicle or trip.
Movian is not responsible for lost, stolen, damaged, or forgotten items except where required by law. If you leave an item behind, Movian may try to help recover it, but recovery is not guaranteed.
You should keep medication, identification, wallets, phones, keys, and other valuables with you at all times.
22User Content, Reviews, and Photos
Movian may allow you to submit ratings, reviews, feedback, tags, photos, comments, or other content.
You are responsible for the content you submit. You agree not to submit content that is false, misleading, illegal, offensive, discriminatory, harassing, defamatory, invasive of privacy, infringing, or otherwise inappropriate.
By submitting content to Movian, you give Movian permission to use, display, reproduce, edit, and share that content to operate, improve, and promote Movian, including within the app, website, customer support, community features, and organic social or owned marketing channels.
Movian will not use an identifiable customer photo in paid advertising or promotional materials without appropriate permission.
Movian may remove or edit content that violates these Terms, creates risk, or is inconsistent with the Movian experience.
23Communications and Notifications
Movian may contact you by email, SMS, push notification, in-app message, or phone for service-related purposes, including:
- Account messages
- Booking confirmations
- Receipts
- Payment and refund notices
- Trip reminders
- Pickup and route updates
- Weather, closure, delay, or cancellation notices
- Safety and operational alerts
- Customer support messages
These communications are part of the Movian service.
Movian may also send promotional messages, offers, surveys, or product updates where permitted. You can opt out of marketing emails or adjust available notification preferences, but Movian may still send service-related messages about your account, bookings, trips, payments, safety, or support.
Message and data rates may apply for SMS or mobile communications.
24App and Website Use
Movian grants you a limited, personal, non-exclusive, non-transferable, revocable right to use the Movian app and website for their intended purpose.
You agree not to:
- Copy, modify, reverse engineer, or misuse Movian’s app, website, content, brand, or technology
- Access Movian using unauthorized tools, bots, scrapers, crawlers, or automated systems
- Interfere with Movian’s security, systems, operations, or other users
- Use Movian for unlawful, fraudulent, harmful, abusive, or commercial purposes
- Create fake accounts or duplicate bookings to manipulate availability, pricing, credits, or promotions
- Make speculative, false, impossible, duplicate, or fraudulent bookings
- Attempt to bypass payment, booking, safety, or access controls
- Resell bookings, credits, promo codes, or trip access without Movian’s permission
Movian may suspend or limit access if we believe your use violates these Terms or creates risk.
25Third-Party Services
Movian may use or link to third-party services, including payment processors, map providers, messaging tools, analytics providers, advertising platforms, destination partners, venues, rental providers, ticketing services, and support tools.
Movian is not responsible for third-party websites, services, policies, availability, content, rules, fees, or actions. Your use of third-party services may be subject to their own terms and policies.
If a third-party destination, venue, rental provider, ticketing provider, or activity provider imposes additional rules or requirements, you are responsible for following them.
26Service Availability
Movian may update, modify, pause, discontinue, or limit parts of the service at any time.
We try to provide a reliable experience, but we do not guarantee that the app, website, trips, routes, destinations, pickup points, add-ons, or features will always be available, uninterrupted, accurate, or error-free.
27Intellectual Property
Movian’s website, app, name, logo, brand, designs, text, photos, graphics, software, trip descriptions, and other content are owned by Movian or its licensors and are protected by intellectual property laws.
You may use Movian content only for your personal, non-commercial use of the service. You may not copy, reproduce, modify, distribute, sell, scrape, or commercially exploit Movian content without permission.
28Disclaimers
Movian provides its service on an “as available” basis.
Trip information, destination information, route details, timing, conditions, availability, difficulty levels, recommendations, and other content may change or may not reflect real-time conditions.
To the fullest extent permitted by law, Movian disclaims warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms limits rights that cannot be limited under applicable law.
29Limitation of Liability
To the fullest extent permitted by law, Movian, LLC and its owners, members, managers, employees, contractors, drivers, vendors, partners, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost opportunities, travel disruption, emotional distress, or other similar damages arising from or related to your use of Movian.
To the fullest extent permitted by law, Movian’s total liability for any claim arising from or related to a booking or trip will not exceed the amount you paid to Movian for the booking giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
30No Personal Liability
Movian is operated by Movian, LLC. To the fullest extent permitted by law, any claim arising from or related to Movian, a booking, a trip, the app, the website, or these Terms must be brought against Movian, LLC, and not against any individual owner, member, manager, employee, contractor, driver, vendor, partner, or agent personally.
31Indemnification
You agree to indemnify and hold harmless Movian, LLC and its owners, members, managers, employees, contractors, drivers, vendors, partners, and agents from claims, losses, damages, liabilities, costs, and expenses arising from:
- Your violation of these Terms
- Your misuse of Movian
- Your violation of law or third-party rights
- Your conduct during a trip
- Content you submit to Movian
- Information you provide about another person without permission
- Damage, cleaning, or loss caused by you or someone you booked for
32Disputes
Before starting a formal legal claim, you and Movian agree to first try to resolve the issue informally.
You may contact Movian at support@movian.com with a brief description of the issue and the resolution you are requesting. Movian will make reasonable efforts to respond and work toward a practical resolution.
If a dispute cannot be resolved informally, either party may bring an individual claim in a court with proper jurisdiction. You and Movian agree that disputes will be handled individually and not as part of a class, collective, consolidated, or representative action, except where this limitation is not permitted by law.
33Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
34Changes to These Terms
Movian may update these Terms from time to time.
If we make material changes, we will provide notice through the app, website, email, or another appropriate method. Updated Terms will be effective when posted unless otherwise stated.
Your continued use of Movian after updated Terms become effective means you accept the updated Terms.
